  - Workers are independent contractors engaged directly by builders
  - No same-job/same-pay exposure (that applies to labour-hire firms paying below host rates)
  - Sham contracting risk already assessed as LOW (construction tradies excluded per existing analysis)
- **Action:** Monitor draft report when published May 15. No immediate action needed.

### 2. Payday Superannuation — July 2026
- Super must be paid same day as wages starting July 2026
- **RateRight impact: NONE** — RateRight has no employees and doesn't pay workers. Builders who hire through RateRight are responsible for their own super obligations.
- Worth noting in any compliance guidance we provide to builders on the platform.

### 3. NES Review Submissions — Close 27 Feb 2026
- National Employment Standards review submissions close in 3 days
- **RateRight impact: NONE** — NES applies to employer-employee relationships. RateRight facilitates contractor engagements. No submission warranted.

### Summary

### ⚠️ Risks

- **AirWallex ADI:** Still unresolved. AirWallex is NOT an ADI. Michael likely needs a traditional bank account (CBA/Westpac) to receive grant funds. This takes time to set up.
- **Letters of Intent:** Michael hasn't actioned yet. These need to come from his construction network — can't be generated by the fleet.
